Terms of Service

1. Acceptance of Terms

By accessing or using BandAid Poster ("the Service"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Service. Simple as that.

2. The Service

BandAid Poster is an AI-powered poster generation platform. You provide creative direction (band name, style, colors, event info), and our AI generates custom poster artwork. We use third-party AI image generation services to produce your posters.

3. Content Policy

This is the big one. Our AI generation services have content policies, and so do we. You agree not to use the Service to generate content that is:

  • Pornographic, sexually explicit, or depicting nudity
  • Depicting graphic violence, gore, or torture
  • Promoting hate speech, discrimination, or harassment targeting any group
  • Depicting illegal activities or encouraging illegal behavior
  • Infringing on trademarks, copyrights, or the likeness of real people without permission
  • Containing personal information or doxxing material
  • Promoting self-harm, substance abuse, or dangerous activities
  • Designed to deceive, defraud, or mislead

Our AI providers automatically filter requests that violate these policies. When a request is rejected, you'll know. We also know. See the enforcement section below.

4. Content Policy Enforcement & Strike System

We take content violations seriously. Here's how the strike system works:

Strikes

Every time you submit a prompt that gets rejected by our content filters, you receive a strike. Strikes are tracked per account (or per IP for anonymous users).

Soft Ban (24-Hour Timeout)

After 5 content violation strikes, your access to the poster generator is suspended for 24 hours. During this period, you cannot generate any posters. After 24 hours, your strikes reset and you can use the Service again. Think of it as a cooling-off period.

Hard Ban (Permanent Suspension)

If you trigger a soft ban more than once within a 30-day period, your account is permanently suspended. This means you've been warned, given a timeout, come back, and done it again. At that point, we're done.

Appeals

If you believe your ban was issued in error, you can contact us at jarviscarlsen@gmail.com to appeal. We review appeals on a case-by-case basis. False positives happen — we get it. But a pattern of violations is a pattern.

5. Accounts & Subscriptions

Free users can generate up to 3 posters per month with a free account. Band Pro subscribers ($11.99/month) get 30 posters per month, music links on posters, priority feed placement, and a commercial license.

You're responsible for keeping your account credentials secure. Don't share your account. If we detect account sharing or abuse, we may suspend the account.

6. Intellectual Property & AI-Generated Content

Your content: You retain rights to the creative direction you provide (band names, event details, etc.). AI-generated images are subject to the terms of the underlying AI providers.

Commercial use: Band Pro subscribers receive a commercial license to use generated posters for promotion, merchandise, and print. Free-tier posters are for personal use only.

Our stuff: The BandAid Poster brand, logo, interface, and underlying technology are ours. Don't copy, reverse engineer, or redistribute them.

AI-Generated Likenesses, Faces & Visual Elements

AI image generation models may produce visual elements that resemble real people, places, logos, trademarks, or other identifiable content. These outputs are generated algorithmically and are not intentional depictions of any specific individual or entity. The Company does not control, curate, or review the specific visual content produced by the AI and makes no representations or warranties regarding the originality, legality, or appropriateness of any generated image.

You are solely responsible for:

  • Reviewing all AI-generated images before use, publication, distribution, or print;
  • Ensuring that any generated image does not infringe upon the rights of publicity, privacy, likeness, trademark, copyright, or any other intellectual property or personal rights of any third party;
  • Obtaining any necessary permissions, licenses, or releases before using generated images that contain or appear to contain recognizable faces, likenesses, logos, brand elements, or other identifiable content;
  • Any and all consequences, claims, or liabilities arising from your use, publication, or distribution of AI-generated images, including claims from third parties alleging unauthorized use of their likeness, image, or intellectual property.

The Company provides a tool for generating poster artwork. The Company does not verify, endorse, or assume any liability for the content of generated images. By using the Service, you acknowledge that AI-generated imagery may inadvertently resemble real people or protected content, and you accept full responsibility for how you use any image generated through the Service.

User-Uploaded Assets

If you upload photos, logos, or other assets for use in poster generation, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use such content, including the right to use any person's likeness depicted therein. The Company assumes no responsibility for the content of user-uploaded assets and is not liable for any claims arising from your use of uploaded materials.

7. Rate Limits

Free users are limited to 3 generation requests per minute to prevent abuse. Band Pro subscribers have higher limits. Automated scraping, bot usage, or bulk generation outside of the intended interface is prohibited.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BandAid Poster, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES (COLLECTIVELY, "THE COMPANY") DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free;
  • The results obtained from the Service will be accurate, reliable, or meet your expectations;
  • Any content generated by the AI will be free from defects, inaccuracies, or objectionable material;
  • The Service will be compatible with any particular hardware, software, or network configuration; or
  • Any credits, data, images, or account information stored on the Service will be preserved indefinitely or at all.

You expressly acknowledge and agree that use of the Service is at your sole risk. Any material downloaded, generated, or otherwise obtained through the Service is accessed at your own discretion and risk, and you will be solely responsible for any damage to your property or loss of data that results from use of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO THE COMPANY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN DOLLARS ($10.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE COMPANY'S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Credits, Purchases & Service Interruptions

Poster generation credits (whether free, included with a subscription, purchased as a la carte packs, or granted through promotional invitations) are non-transferable, non-refundable, and carry no cash value. Credits are a limited license to use the poster generation feature and do not represent a stored balance, deposit, or any form of currency.

You expressly acknowledge and agree that:

  • Credits may be lost, reduced, reset, or rendered unusable due to service outages, system errors, platform updates, account changes, security incidents, or discontinuation of the Service, without prior notice and without any obligation on the part of the Company to restore, replace, or compensate you for such credits;
  • The Company may modify, suspend, or discontinue the credit system, pricing structure, or any aspect of the Service at any time without liability;
  • Unused credits expire and are forfeited upon account termination, whether initiated by you or by the Company;
  • Failed poster generations (due to AI content filters, network issues, third-party service outages, or any other cause) may consume a credit, and the Company is under no obligation to restore credits for failed or unsatisfactory generations;
  • Promotional credits, invite bonuses, and free-tier credits are provided at the Company's sole discretion and may be modified or withdrawn at any time.

Credit Disputes

If you believe credits were lost or consumed in error — for example, due to a technical issue, a failed generation that should not have been charged, or an account discrepancy — you may submit a dispute by emailing jarviscarlsen@gmail.com with your account email, a description of the issue, and any relevant details (such as approximate date, time, and what you were attempting to generate). We will review disputes in good faith and on a case-by-case basis. While the Company is under no obligation to restore credits, we are committed to treating our users fairly and will make reasonable efforts to resolve legitimate concerns.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any content you submit to or generate through the Service; or (e) any dispute between you and a third party relating to posters or other content generated through the Service.

12. Third-Party Services

The Service relies on third-party providers for AI image generation, image hosting, payment processing, email delivery, and other functionality. The Company is not responsible for the availability, accuracy, or performance of any third-party service, and the failure or degradation of any third-party service shall not give rise to any claim against the Company.

13. Termination

We reserve the right to suspend or terminate your access at any time, for any reason or no reason, with or without notice. You may delete your account at any time by contacting us. Upon termination, all licenses granted to you under these Terms immediately cease, and any unused credits are forfeited without refund.

Subscription cancellations take effect at the end of the current billing cycle. To avoid future charges, cancel before your next billing date. No partial refunds are provided for unused portions of a billing period.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE COMPANY.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

17. Changes to Terms

We may update these Terms at any time by posting the revised version on this page with an updated effective date. Your continued use of the Service after any such changes constitutes your binding acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service.
